1. about luck contemporary
luck contemporary is an independent online gallery specialising in limited-edition prints and selected collectible works by contemporary artists.
these terms and conditions apply to your use of the luck contemporary website at luckcontemporary.com and to purchases made through the gallery.
in these terms, “luck contemporary”, “we”, “us” and “our” refer to the business operating the gallery. “you” and “your” refer to any person visiting the website, making an enquiry or purchasing an artwork.
by using our website or purchasing an artwork from us, you agree to these terms and conditions.
business details: luck contemporary limited, 61 edburton avenue, Brighton, bn1 6el luck@luckcontemporary.com
2. our artworks
we offer a carefully selected range of limited-edition prints and other collectible works. each artwork is described individually on our website, with information provided where available about the artist, title, edition, publisher, medium, dimensions, condition, framing and provenance.
we take care to ensure that the information we publish is accurate and reflects the information available to us. if you require further information, photographs or clarification about an artwork before purchasing, please contact us.
artworks are offered subject to availability. an artwork may be withdrawn from sale if it is no longer available or if we identify an error in its listing.
3. artwork images and descriptions
we make every reasonable effort to represent each artwork accurately through our photographs and descriptions.
however, colours and details may appear differently depending on your screen, device and display settings. photographs are intended to illustrate the artwork and should be considered alongside its written description.
where dimensions are provided, these refer to the artwork as specified in the listing and may not include the frame or mount unless stated.
any known condition issues or relevant qualifications will be described as clearly as reasonably possible. if condition is particularly important to your decision, we encourage you to request further information before proceeding.
4. enquiries and purchases
our website allows you to enquire about artworks directly with the gallery.
an enquiry does not constitute a purchase or reserve an artwork. a sale is agreed only when we have confirmed acceptance of your purchase in writing and the relevant payment arrangements have been agreed.
before confirming a purchase, we will agree with you the artwork being purchased, the price, delivery arrangements and any other relevant terms.
we reserve the right to correct genuine errors in pricing or descriptions and to decline an enquiry or proposed transaction where necessary. if a price or listing error affects a purchase that has already been agreed, we will contact you to discuss the appropriate next steps.
5. prices and payment
all artwork prices are stated in pounds sterling (£) unless expressly indicated otherwise.
delivery is charged separately unless we have explicitly agreed otherwise. the delivery cost will be quoted individually and confirmed with you before the purchase is completed.
any applicable taxes, duties or other charges will be explained where relevant. international purchases may be subject to additional import charges, as described in section 8.
payment arrangements will be agreed with you before the sale is completed. we may require payment in full before arranging delivery or collection.
ownership of an artwork will pass to you once payment has been received in full, subject to any applicable legal requirements.
6. condition, authenticity and provenance
we aim to provide clear and accurate information about the condition, authenticity and provenance of the artworks we offer, based on the information and documentation available to us.
condition can vary between artworks, particularly in the secondary market. an artwork may show signs of age, handling, display or storage. any material condition issues known to us will be disclosed in the listing or discussed with you before purchase.
where applicable, details of edition numbers, publishers, certificates of authenticity and provenance documentation will be provided as stated in the individual listing. not every artwork will have a separate certificate or complete provenance documentation.
we do not issue certificates of authenticity unless expressly agreed in writing. any certificate or supporting documentation supplied with an artwork will be identified where applicable.
if you have questions about an artwork's condition, authenticity or provenance, please contact us before purchasing. nothing in these terms excludes or limits your statutory rights where an artwork is not as described or does not meet the requirements of applicable law.
7. delivery and collection
delivery is arranged individually according to the artwork's size, value, condition and destination.
we use appropriate packing and delivery arrangements for the work concerned, with specialist handling, tracking and insurance where appropriate. delivery costs are additional to the artwork price and will be quoted before the purchase is completed.
complimentary personal delivery may be available within brighton and hove, subject to agreement.
for uk and international deliveries, we will confirm the arrangements and estimated timescales with you before proceeding. some artworks may require specialist packaging, crating or additional preparation, which may affect delivery times and costs.
delivery estimates are given in good faith but may be affected by circumstances outside our control. if we become aware of a significant delay, we will communicate this to you.
you are responsible for providing an accurate delivery address and contact details. please notify us promptly if any details change.
please inspect the packaging and artwork on arrival. if an artwork appears to have been damaged in transit, retain the packaging where possible and contact us as soon as possible with photographs and details of the damage. this does not affect your statutory rights.
8. international orders, customs and import charges
we welcome enquiries from international collectors, subject to our ability to arrange suitable delivery.
delivery outside the united kingdom may involve customs declarations, import duties, taxes, clearance fees or other charges imposed by the destination country. unless we expressly agree otherwise in writing, these charges are the responsibility of the buyer.
you are responsible for checking any import restrictions or requirements that apply in your country. we cannot guarantee that an artwork will be exempt from customs charges or that customs clearance will take place within a particular timescale.
we will discuss the proposed delivery arrangements and any known additional costs with you before confirming an international sale.
9. cancellations, returns and refunds
we want you to feel confident when purchasing from luck contemporary. if you have concerns about an artwork, please contact us as soon as possible.
where a purchase is made online or through another distance-selling arrangement, you may have a statutory right to cancel within 14 days of receiving the artwork, subject to applicable law. we will provide the relevant cancellation information and instructions where required.
if you exercise a statutory right to cancel, you will normally be responsible for the direct cost of returning the artwork unless we have agreed otherwise or the law requires us to bear that cost. given the nature and value of artworks, we ask that returns are arranged using a secure, tracked and appropriately insured delivery service agreed with us in advance.
please take reasonable care of an artwork while it is in your possession and when arranging its return. where permitted by law, a deduction may be made for any reduction in value resulting from handling beyond what is necessary to establish the artwork's nature, characteristics and condition.
we will explain the return arrangements and applicable refund process when a cancellation is requested. refunds will be made in accordance with applicable law.
if an artwork arrives damaged, is faulty or is materially different from its agreed description, please contact us promptly with details and supporting photographs. we will work with you to resolve the issue in accordance with your statutory rights.
nothing in this section affects any rights you may have under consumer protection legislation. where a statutory cancellation right does not apply, any other return or refund arrangement must be agreed with us in writing.
10. copyright and intellectual property
all artwork remains subject to the copyright and other intellectual property rights of the relevant artist or rights holder.
purchasing an artwork gives you ownership of that physical item, subject to these terms and applicable law. it does not transfer copyright or grant you permission to reproduce, publish, distribute or commercially exploit the artwork.
the text, photographs, design and other content on the luck contemporary website may not be copied, reproduced or used commercially without our prior written permission or the permission of the relevant rights holder.
11. website information and availability
we take reasonable care in maintaining our website and keeping its content accurate and available. however, we cannot guarantee that the website will always be uninterrupted, error-free or available at all times.
we may update, amend or remove website content, including artwork listings, where necessary. changes to a listing do not alter the terms of a purchase that has already been agreed, except where permitted by law or agreed with you.
12. liability
nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or any rights and remedies available to consumers under applicable law.
subject to the above, we will not be responsible for losses arising from circumstances beyond our reasonable control, including delays caused by third-party delivery providers, customs authorities or events outside our control.
we do not exclude responsibility for our own obligations in relation to the sale of an artwork, and nothing in these terms limits your statutory rights.
13. privacy and personal information
we handle personal information in accordance with our privacy policy, available on the luck contemporary website.
information supplied to us in connection with an enquiry or purchase will be used as necessary to respond to your enquiry, administer the transaction, arrange delivery and meet our legal obligations.
please refer to our privacy policy for further information about how personal information is collected, used and protected.
14. changes to these terms
we may update these terms and conditions from time to time. the version published on our website will apply to future enquiries and purchases, subject to any terms already agreed with you and any applicable legal requirements.
15. governing law
these terms and conditions are governed by the laws of england and wales.
if you are a consumer, nothing in this section removes any mandatory protections or rights available to you under the law that applies to your circumstances.
16. contact us
if you have a question about these terms, an artwork or an existing purchase, please contact luck contemporary through the contact details provided on our website.
we will aim to respond as promptly as reasonably possible.
